The service is operated by УАЙ ДИ ЕЙ ЕООД (YDA Ltd, “we”), registered in Bulgaria under number 206471089, with its registered office at Drujba, bl. 170, ent. B, fl. 7, apt. 67, 1592 Sofia, Bulgaria. You can reach us at contact@elefan.app.
The service gives a practice an online agenda and lets its patients request appointments. A request is only an appointment once the practice confirms it — we never confirm, decline or reschedule on a practice’s behalf.
A patient account works at every practice on elefan.app. Practice accounts are created by the practice owner, who decides who joins the team and with which role. Keep your credentials to yourself: anything done from your account is treated as done by you.
The practice is responsible for the care it provides, for its opening hours and prices, and for the patient records it keeps here. We are responsible for running the software. We are not a party to the relationship between a patient and their practice, and we give no medical advice of any kind. In an emergency, contact your practice or the emergency services directly — do not rely on an online booking request.
We aim to keep the service available but cannot guarantee uninterrupted access; maintenance and incidents happen. A practice should keep a way to reach its patients that does not depend on this service.
elefan.app is currently free of charge. We may introduce paid plans later. If we do, we will tell you at least 90 days beforehand, by email to the address on the practice account and with a notice inside the app. Nothing is ever charged retroactively, and no card is required to keep using the service until a plan you have accepted starts. If you do not want to continue on paid terms, you can download a full copy of your practice’s data at any time from Practice settings → Your data, and write to us before the change takes effect to close the account — your data stays available to you, and exportable, throughout the notice period.
We announce changes the same way: by email to the practice account and in the app. Minor corrections take effect on publication; anything that materially changes your rights or obligations is announced at least 30 days beforehand, and continuing to use the service after that date means you accept it.
These terms are governed by the law of Bulgaria, and the courts of Bulgaria have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory rules in your country of residence.
The service is provided as it stands. We are liable for damage we cause by failing to run it with reasonable care, but not for indirect or consequential loss — lost revenue, lost patients, or the cost of appointments missed because the service was unavailable. Since the service is free of charge, no fees have been paid that could measure such a claim; if paid plans are introduced, our total liability over any twelve-month period will not exceed what you paid us during it.
Nothing here limits liability that the law does not allow us to limit — in particular for death or personal injury caused by our negligence, for fraud, or for intentional or grossly negligent conduct. Clinical decisions are the practice’s: we are not liable for the care given, for an appointment a practice confirms, declines or forgets, or for what a practice records about a patient.
You may close your account at any time by writing to contact@elefan.app.
We may suspend or close an account that is used unlawfully, that puts the service or other users at risk, that abuses the system, or where a law or a court requires it. Except where the risk is immediate, we tell you first, say why, and give you 14 days to put it right. Where we have to act immediately, we tell you as soon as we reasonably can and restore access once the cause is resolved. We do not suspend an account to settle a commercial disagreement.
We may also stop offering the service altogether, with at least 90 days notice. In that case, and whenever an account closes, you can take your data with you: download it from Practice settings → Your data while the account is open. After closure we keep it for 30 days so it can still be retrieved — write to us within that window and we will send you a copy — then delete it, except where the law requires us to keep it longer.
How we handle personal data is described in our privacy policy and cookie policy. A practice processing patient data through elefan.app should also have a data processing agreement with us.
